Shared Custody Calculation Method

Joint Custody Note: New York State does not have a statutory formula for 50/50 custody. Regardless, strict application of some caselaw (Bast v. Rossoff), which may be challengeable, has the higher earner to pay the full pro-rata share to the lower earner. However, this calculator defaults to use the “Offset Method” (Parent A obligation minus Parent B obligation), which is a common method used in mediation and settlements, unless “‘Monied’ Parent Pays” is selected in the calculator instead.
