No Fault Divorce in New York
A few years ago, the New York Legislature adopted the newest legal ground to get divorced, commonly called a no fault divorce. It is also known as the irretrievable breakdown in relationship Domestic Relations Law 170 (7).
To get a divorce on this ground, the marital relationship must have broken down irretrievably (so that it is impossible to repair or reconcile for a period of at least six months).
Also, there are some additional requirements to fulfill in order to finalize your divorce under this legal provision including that the parties need to resolve all of the necessary issues in some type of settlement agreement.
